A “statement of use” is an applicant’s (or authorized representative’s) signed, sworn statement attesting to use of the mark in commerce. With each “statement of use”, the owner must submit:

  • a filing fee for each class of goods/services; and
  • one specimen showing use of the mark in commerce for each class of goods/services.

With an “intent to use” application a “statement of use” must be filed within 6 months from the date the USPTO issues a notice of allowance. Failure to timely submit a “statement of use”, or an extension of time request, results in abandonment of the application.
