Trademark registrations renewals are required every 10 years from the initial registration date. To renew a trademark the owner must pay a maintenance fee and provide an affidavit of use to prove use in commerce before the expiration date. There’s also a 6 month grace period after the renewal date (added fee). Without renewal, the registration will lapse. Yet if a registration lapses and the mark is still in use, the owner maintains common law usage rights. Since trademarks are recyclable anyone can register a lapsed registration, and rights can be created anew.
