A petition to revive an application is a motion to the United States Patent and Trademark Office (USPTO) to restore an abandoned application to active status. A petition to revive an application must be received in the USPTO within two (2) months from the issue date of the notice of abandonment. The question the petition must answer is whether or not the reason for not replying was intentional or unintentional. It is likely that the petition will be accepted if it is timely filed and the failure to respond was unintentional.
