A trademark or service mark is unusual in the context of its use so as to distinguish it from all others, and therefore is memorable. Distinctive marks typically consist of terms that are suggestive (Best Buy electronics store), fanciful or arbitrary (Ritz crackers), or coined (Xerox photocopies). Distinctive marks usually benefit from the highest judicial protection under federal and state laws.
