A provisional patent application becomes abandoned after 12 months from the date the provisional application is filed, and no extensions are allowed. For example, if a provisional application is filed May 26, 2011, it becomes abandoned at 12:01 AM on May 27, 2012. In order to claim the provisional application’s priority, a non-provisional application must be filed during the provisional application’s 12-month pendency period.
