A non-obvious invention is patentable if the invention is a new, useful, AND a non-obvious improvement over the prior art (ALL 3 criteria must be met). If, based upon the prior art, the invention would have been obvious to a person having ordinary skill in the art at the time the invention was made, then the invention is NOT patentable.
