An independent or distinct patent application, carved out of a pending application, which discloses and claims only subject matter disclosed in the earlier or parent application, is known as a divisional application or “division.” This application must claim the benefit of the prior non-provisional application per 35 USC 121 or 365(c) and is often filed due to an examiner’s restriction requirement.
